Van Driving Policy Agreement
SCOPE OF POLICY
Alaska Arts Southeast (AASE) Motor Vehicle Use Policy governs the use and maintenance of all AASE vehicles for all employees, faculty, staff and volunteers.
VEHICLE OPERATOR PRIVILEGES
A. Vehicle Operator Privileges. AASE vehicle operator privileges will be available to employees, faculty, staff and volunteers, who possess a current valid license to operate a motor vehicle in the state of Alaska.
1. The driver must submit a copy of his or her valid Driver’s License to the AASE Office during the year of required use.
B. Loss of License. AASE vehicle operator privileges are invalid upon the end of each calendar year, revocation, suspension or expiration of a license to operate a motor vehicle. An authorized driver must report the suspension or revocation of his or her license AASE Program Director or designee.
C. Compliance. AASE Program Director or designee may suspend or revoke an authorized driver's AASE vehicle operator privileges for failure to comply with any provision of this policy. The Program Director or designee will notify an authorized driver when his or her AASE vehicle operator privileges have been revoked.
D. Vehicle Assignments. Only the AASE Program Director or designee may assign the use of AASE vehicles. Requests for specific vehicles may not always be honored.
OCCUPANCY OF VEHICLES.
A. Authorized Use. Except as provided in subsections C and D, AASE vehicles may be occupied only by authorized drivers and authorized passengers. Operators are authorized to use AASE vehicles only in the furtherance of official AASE business, or for agreed upon business.
B. Unauthorized Use. Except as provided in subsection C and D, an employee, faculty, staff or volunteer of AASE who permits an AASE vehicle to be driven by an unauthorized driver or who transports or permits the transportation of an unauthorized passenger shall have his or her AASE vehicle operator privileges suspended or revoked and may be held personally liable to the extent permitted by law for any liability for any personal injury, death or property damage arising out of the unauthorized use or occupancy of the AASE vehicle.
C. Special Need. In cases of special need, the AASE Program Director or designee may authorize a person who would not qualify as an authorized passenger to drive or occupy a AASE vehicle. The authorization must be in writing and must be obtained before such person drives or occupies a AASE vehicle.
D. Emergency Aid. Nothing in this section shall be construed to prohibit the use or occupancy of an AASE vehicle to render emergency aid or assistance to any person.
INTOXICATING LIQUOR, DRUGS AND TOBACCO PRODUCTS.
A. Use of Liquor, Drugs and Tobacco Products are Prohibited. Employees, faculty, staff or volunteers of AASE may not drive an AASE vehicle while under the influence of intoxicating liquor or drugs nor may he/she smoke any tobacco products while in the vehicle.
B. Penalty for DWI Conviction. An employee, faculty, staff or volunteer of AASE who is suspected of or convicted of driving an AASE while under the influence of intoxicating liquor or drugs may be terminated from employment at AASE and or have their driving privilege suspended. Any employee, faculty, staff or volunteer of AASE who were passengers in the vehicle may also be terminated from AASE employment where it is shown that they knew or should have known that the driver was under the influence of intoxicating liquor or drugs and did not take reasonable action to prevent the driver from driving the vehicle.
TRAFFIC LAWS AND SEAT BELTS.
A. Traffic Laws. The failure to obey any applicable traffic law while driving or occupying an AASE vehicle may result in suspension or revocation of the AASE vehicle operator privileges of all authorized drivers in the vehicle.
B. Seats Belts Required. All occupants of AASE vehicles must wear seat belts. The failure of any person to wear a seatbelt while driving or occupying an AASE vehicle may result in the suspension or revocation of the AASE vehicle operator privileges of all authorized drivers in the vehicle.
C. Responsibility for Traffic Conditions. Any employee, faculty, staff or volunteer of AASE who receives a traffic citation or parking ticket while using an AASE vehicle will be personally responsible for the citation or ticket.
CARE OF VEHICLES - ACCIDENTS - LIABILITY.
A. Care of Vehicle. Prior to using an AASE vehicle, the operator shall do a walk around of the vehicle to determine that all tires are inflated properly and that the brakes, lights, windshields wipers, seat belts and steering are functioning properly. Any discrepancies shall be reported to the AASE Program Director or designee who will determine the extent of the vehicle use and insure a work order for the discrepancy is submitted to the maintenance department.
B. Leaving the Vehicle. The operator of an AASE vehicle will turn off the ignition, close all windows, and lock the doors and trunk of the AASE vehicle whenever the vehicle is left unattended.
C. Liability for Loss or Damage. The operator of an AASE vehicle will not abuse or misuse an AASE vehicle. The operator of a damaged AASE vehicle may be assessed for the loss or damage of an AASE vehicle if the loss or damage was caused by:
E. Accidents. If involved in an accident resulting in bodily injury or property damage, an employee, facility, staff or volunteer of AASE shall notify the AASE Office by telephone and submit a complete accident report by the next working day. Failure to comply with this subsection may result in suspension or revocation of the AASE vehicle operator privileges of all authorized drivers who were in the vehicle at the time of the accident
MECHANICAL OR OPERATIONAL FAILURE.
A. Mechanical or Operational Deficiencies. A work order will be completed for all mechanical or operational deficiencies that occur while an AASE vehicle is being used for official AASE business, and submitted with the vehicle keys to the AASE Office. In no case will an employee, facility, staff or volunteer of AASE continue to operate an AASE vehicle if continued operation could endanger any person or property.
VEHICLE RETURN.
A. Immediate Return Required. Immediately upon completion of a trip, the authorized driver must return the AASE vehicle. AASE vehicles may not be kept overnight following a trip.
B. Return During Business Hours. Whenever an AASE vehicle is returned during regular business hours, the AASE employee, facility, staff or volunteer shall return the vehicle keys to the AASE Office and report any vehicle defects as outlined above.
C. Return After Business Hours. When it is necessary for an employee, facility, staff or volunteer of AASE to return an AASE vehicle before or after normal working hours, they will:
GASOLINE AND OTHER RELATED PURCHASES.
A. Refueling. Only authorized maintenance staff members may fill the vans with gas, using our Delta Western Fleet Cards. Authorized maintenance staff will check the gas levels periodically and refill if the tank is less than ¼ full. Other personnel using the vans should notify the office and/or maintenance staff when returning the van if the tank is less than ¼ full.
NOTE: Do not take any of the vans up Harbor Mountain. Vans are not safe to drive up the Harbor Mountain Road.
Summary of USE
Alaska Arts Southeast vehicles may only be used for official business. You must possess a valid driver’s license, take good care of the vehicles and return them to their regular parking spots in good condition.
